Sweepstakes is offered only in the fifty (50) United States and the District of Columbia and is open to their legal U.S. residents 18 years or older as of time of entry. Non-Purchase Entries and Purchase Entries Have an Equal Chance of Winning. The eBay Motors Pepsi 400 Conseco Sweepstakes ("Sweepstakes") begins at 10:00 AM (PT) June 6, and ends at 11:59:59 PM PT June 15, 2002 ("Promotional Period") 1. To Enter: You will be entered automatically when you visit http://pages.ebay.com/ebaymotors/pitcrew and complete and submit the official entry form online. Incomplete entries are not valid. Only one entry per person. Subsequent entries from the same person will be disqualified. All entries must be submitted by 11:59:59 PM (PT) on June 15, 2002. Entries, and the use of information provided by entrants to eBay Inc. ("Sponsor") therein, will be subject to Sponsor's privacy policy and user agreement posted at the eBay website located at www.ebay.com (the "eBay Site"). 2. Drawing: On or about June 17, 2002, a random drawing will be conducted by Marden-Kane, Inc., an independent judging organization, from among all eligible entries received. The prize will be awarded. 3. Odds: Estimated odds of winning are 1:5,000; however, the actual odds of winning depend upon the total number of actual eligible entries received. 4. Prize: One (1) trip for two to the Nascar Pepsi 400 race in Daytona, Fl. on July 6, 2002. Trip includes all of the following: (i) air transportation (coach) from and to the winner's home from a major airport nearest the winner's home, unless winner lives within a reasonable driving distance from the venue, as determined by the Sponsor at its sole discretion; (ii) hotel accommodations for two [2] nights (one standard double room); (iii) car rental for one car for three [3] days (subject to the terms and conditions of the car rental company, and does not include any insurance, taxes or refueling charges and or any other expenses); (iv) $300 cash; and (v) Pit and Garage Access for the No. 14 NASCAR Winston Cup team, sponsored by Conseco at the Pepsi 400 in Daytona on July 6 for the winner and one (1) guest, plus two [2] Crew Shirts (winner and guest must be 18 years or older for pit pass entry and will be required to show their social security card and a valid photo identification, for purposes of identification). Approx. retail value, $2,500. Value will vary dependent upon city of departure. Winner must be able to travel during the period July 5 to July 7, 2002, or prize will be forfeited and awarded to an alternate winner. No prize substitution, cash equivalent, or transfer of prize permitted except that the Sponsor, at its sole discretion, may substitute a prize of equal value for any reason. Prize awarded subject to availability. Winner is responsible for payment of all taxes on prize and for any other expenses relating to the acceptance and use of the prize not specified herein. In addition, the winner and guest are responsible for obtaining travel insurance (and all other forms of insurance) and hereby acknowledges that Sponsor has not and will not obtain or provide travel insurance or any other form of insurance 5. Eligibility: Sweepstakes open to all legal U.S. residents in the 50 United States and the District of Columbia, 18 years of age and older as of the date of entry. Employees of Sponsor, NASCAR, Conseco Services, L.L.C., their parent companies (where applicable)and their respective subsidiaries and affiliates, and the advertising and promotion agencies of Sponsor and NASCAR, including Marden-Kane, Inc. and its affiliates, and the immediate families (spouse, parents, children and siblings, and each of their respective spouses, regardless of where they live) and persons living in the households of such individuals, whether related or not, are not eligible to participate. Void where prohibited or restricted by law. The Sweepstakes is subject to all applicable federal, state, and local laws and regulations. By participating, entrants agree to abide by and be bound by these Official Rules, agree to waive any right to claim ambiguity in the rules, and agree to accept the decisions of the Sponsor and Marden-Kane, Inc. as final in all matters relating to the Sweepstakes. 6. Winner Notification: The potential winner will be notified by telephone on June 18, 2002 between the hours of 9:00AM and 8PM (ET) followed by written confirmation via FedEx priority overnight. If the person contacted cannot be reached between the hours mentioned above on June 18 they will be declared ineligible and an alternate will be notified on June 19 via the same method described above. This same procedure will be followed until such time that an entrant has accepted the prize. In the event Sponsor decides, at its sole discretion, that the prize cannot be awarded in time for a winner to attend the race on July 6, 2002, Sponsor will have no further obligation other than to select another race later in the season similar to that described in #4 above and award such trip in a sweepstakes drawing from all eligible entries received. In such an event, winner will be given 30 days advance notice as to the dates and location. Winner will be required to complete and sign an Affidavit of Eligibility and Liability Release, and where legal, a Publicity Release, and furnish his/her social security number which will be used only for the purpose of reporting the winner's prize earnings to the Internal Revenue Service as required by law. These documents must be returned within 7-days via FedEx priority overnight or prize will be forfeited and awarded to an alternate winner. If the prize or prize notification is unclaimed or returned as undeliverable, the prize will be forfeited and awarded to an alternate winner. Winner's travel companion must be 18 years or older, unless they are an immediate family member, and will be required to sign a Liability Release/Publicity Release prior to issuance of the travel documents. If an entrant changes his/her telephone number and/or address after he/she enters the Sweepstakes, it is his/her sole responsibility to notify the Sponsor by (postal) mailing notice to the Sweepstakes Administrator address (listed below) to be received by the end of the Promotional Period. By entering the Sweepstakes entrants agree to the use of their name and photograph/likeness for advertising and promotional purposes for this and similar promotions, worldwide, and in perpetuity, in any and all forms of media, now known or hereafter devised (including and without limitation, the Internet) without additional compensation, except where prohibited by law. 7. Limitation of Liability: By participating in the Sweepstakes entrants agree to release, indemnify and hold harmless eBay Inc., NASCAR, Conseco Services, L.L.C., A.J. Foyt Enterprises, Inc., Marden-Kane, Inc. and their parent companies (where applicable), and any and all their affiliates, subsidiaries and their respective agents, representatives, officers, directors, shareholders and employees (collectively, "Releasees") from and against any injuries, losses, damages, claims, actions and any liability of any kind resulting from or arising from participation in the Sweepstakes or acceptance, possession, use, misuse or nonuse of the prize that may be awarded. Entrants agree that any and all disputes will be governed by the laws of the state of California. Entrants hereby acknowledge that Sponsor has neither made nor is in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to the prize, including express warranties (if any) provided exclusively by a prize supplier that are sent along with the prize. Releasees are not responsible for printing or typographical errors in any Sweepstakes related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this promotion, or process any transaction thereon. If in the Sponsor's opinion, there is any suspected or actual evidence of use of automated entry devices or programs or electronic or non-electronic tampering with any portion of the Sweepstakes, or if computer virus, bugs, unauthorized intervention, fraud, or technical difficulties or failures compromise or corrupt or affect the administration, integrity, security, fairness, or proper conduct of the Sweepstakes, the judges reserve the right at their sole discretion to disqualify any individual who tampers with the entry process and or void any entries submitted fraudulently, to modify or suspend the Sweepstakes or to terminate the Sweepstakes and conduct a random drawing to award the prize using all non-suspect entries received as of the termination date. Sponsor reserves the right to modify or terminate the Sweepstakes in its entirety at any time, and for any reason, at Sponsor's sole discretion.
